1. Acceptance of Terms
By downloading or using the Eto Rides app or website, you confirm that you are at least 18 years of age and agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the platform. Material changes to these Terms require your re-acceptance before they take effect; continued use after minor updates constitutes acceptance.
2. Who We Are and What Eto Rides Does
Eto Rides is a technology platform operated as a sole proprietorship (GSTIN: 19DKFPB7926E1Z5; Trade Licence: 0917P164625375158), registered at 276/B/I, Lokepur, Kenduadihi, Bankura, West Bengal – 722102, India.
We provide a SaaS technology platform that connects passengers with independent electric e-rickshaw captains. Eto Rides is not a transport company. Captains are independent service providers — not employees, agents, or partners of Eto Rides.
Eto Rides is applying for an On-Demand Transportation Technology Aggregator (ODTTA) licence under Section 93 of the Motor Vehicles (Amendment) Act 2019. Until that licence is granted, we operate under a SaaS subscription model. These Terms will be updated upon grant of the licence.
3. Eligibility and Age
- You must be 18 years or older to use Eto Rides. By creating an account, you represent that you meet this requirement.
- Persons under 18 must not create accounts. If we discover a minor has registered, we will delete the account and all associated data.
- Passengers must provide a valid phone number for OTP-based authentication.
4. Captain Accounts
- Captains must complete identity verification and document verification before account activation.
- You must maintain a valid driving licence, vehicle registration certificate, and valid commercial vehicle insurance at all times while operating on the platform.
- Insurance: All captains are required by law to maintain valid third-party commercial vehicle insurance under the Motor Vehicles Act 1988. Passengers involved in an accident should contact us immediately at support@etorides.com for insurance claim assistance.
- Your account is personal and non-transferable. Sharing login credentials is prohibited.
- We reserve the right to suspend or terminate accounts that violate these Terms, receive sustained poor ratings, or are involved in fraud.
5. Captain Subscription
- Access to the captain platform requires an active paid subscription. Plans and pricing are listed in the app.
- Subscription payments are processed via Razorpay on our website (etorides.com/captain-subscribe). No in-app purchase is made through Google Play or any app store.
- Subscriptions are non-recurring — you renew manually when your plan expires.
- The Standard plan includes a daily ride limit; the Premium plan has no daily ride limit. Limits are enforced at each ride acceptance and reset at midnight IST.

6. Ride Fares and Payments
All ride fares are paid directly by passengers to captains via cash or UPI at the conclusion of each trip. Eto Rides does not hold, process, or intermediate ride fare payments. The platform is not a Payment Aggregator for ride fares under RBI guidelines.
If you have a dispute about a UPI payment made to a captain, contact us within 24 hours at support@etorides.com with the UPI transaction reference ID.
7. Acceptable Use
You must not:
- Use the platform for any unlawful activity
- Harass, abuse, or harm other users or captains
- Attempt to reverse-engineer, scrape, or interfere with the platform
- Create fake accounts or submit fraudulent documents
- Manipulate ratings, reviews, or pricing
Violations may result in immediate account suspension without refund.
8. Location Services
The app requires location access to function. Captains grant background location access while the app is running (online or on an active ride) for real-time dispatch and passenger safety tracking. See our Privacy Policy for full details on location data lifecycle and your rights.
9. Limitation of Liability
To the maximum extent permitted by Indian law, Eto Rides is not liable for:
- Acts or omissions of captains or passengers
- Loss of earnings due to platform downtime or technical issues
- Indirect, incidental, or consequential damages
- Any loss arising from events outside our reasonable control (see Force Majeure, Section 11)
Our total liability to you for any claim is limited to the amount you paid us in captain subscription fees in the three months preceding the claim.
10. Intellectual Property
All content on the Eto Rides platform — including the app, website, logos, trademarks, and software — is the property of Eto Rides or its licensors. You may not reproduce, distribute, or create derivative works without our written permission.
11. Force Majeure
Eto Rides is not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, government actions, internet or telecommunications failures, or civil disturbances.
12. Governing Law and Disputes
These Terms are governed by the laws of India. Any disputes arising from these Terms or the use of the Eto Rides platform are subject to the exclusive jurisdiction of courts in Bankura, West Bengal, India.
